CONTEST RULES

Nyluxe PetGuard: Tailored for Paws (the "Contest") From July 1st at 9:00 a.m. [EDT] to September 30, 2023 at 11:59 p.m. [EDT] (the "Contest Period") Organized by Beaulieu Canada (the "Sponsor") (hereinafter referred to as the "Sponsor/Prize Provider") 

 

TERMS OF ENTRY​

 

1. No purchase necessary. This Contest is open to Canadian residents only and is governed by Canadian law. To enter the Contest, simply go to the Beaulieu Canada website, in the "Contest" section, submit the entry form during the Contest Period and click on the button for accepting the rules to submit your entry. Submission of an entry in the Contest signifies that you have read the Contest rules and agree to abide by them. You agree that submitting an entry to the Contest through the Website or any other electronic platform constitutes an electronic signature on your part, which binds you to these rules. Boxes on the form marked with an asterisk or otherwise indicated as mandatory must be completed in order to enter the Contest. Other requested information is helpful, but is not required to enter the Contest. To be valid, entries must be received by September 30, 2023 at 11:59 p.m. [EDT]. Any person who enters or attempts to enter more than the permitted number of times, or who uses any robotic, automatic, mechanical, electronic or other method of duplication not permitted by these rules, will be considered to have engaged in tampering or manipulation, which will automatically void his/her entry, vote or any other results of such entry. No entries will be accepted after the above deadline for any reason. Entries received after this deadline will be disqualified.

 

 

1.1.    Beaulieu Canada reserves the right, at its sole discretion, for any reason whatsoever, to disqualify any entry deemed inappropriate. By submitting your content to Beaulieu Canada in connection with this Contest, you grant Beaulieu Canada a royalty-free, perpetual, non-exclusive, irrevocable, unrestricted, worldwide license to publish, reproduce and distribute your entry in any and all media, on any and all platforms and through any and all other means of communication controlled or authorized by Beaulieu Canada in connection with the Contest and Beaulieu Canada's promotions in connection with the Contest. You waive all moral rights to your entry when it is used for these purposes. You authorize Beaulieu Canada to use your name, image and voice, at its sole discretion, in connection with the use of your entry. The application of a collective agreement may be required. The list of winners and the winning entries may be posted on Beaulieu Canada's and its participants' platforms for an indefinite period after the Contest closes.


 

1.2.    ELIGIBILITY

 

Participants must be residents of Canada and be of the age of majority in their province at the time of the Contest. Any person affiliated with Beaulieu Canada, its employees and their families or its business partners and their families are not eligible for this contest.


 

1.3.    METHOD OF AWARDING PRIZES

 

A random draw will be held on October 5th, 2023 from all eligible entries received during the Contest Period. The first entrant selected by lot who correctly answers a mathematical skill-testing question will be declared the winner of $1,000 in the form of a Nyluxe PetGuard and Nyluxe PetGuard Tri-Twist coupon redeemable at a Beaulieu Canada retailer, subject to fulfilling all the conditions stipulated in these Contest rules. The potential winner will be contacted by telephone, email or social media account at the number or information indicated on the entry form or used to enter and must claim his/her prize according to Beaulieu Canada's instructions. In the event that a potential winner does not claim his/her prize within 30 days or incorrectly answers the mathematical skill-testing question (if applicable), declines the prize or is declared ineligible, the prize will be automatically forfeited and Beaulieu Canada may, at its sole discretion, designate another potential winner, even if the potential winner's name has already been publicly announced. Cancelled prize will not be awarded. Beaulieu Canada may, in its sole discretion, require proof of identity or age from an entrant. Refusal to provide the requested proof will automatically result in disqualification of the entrant.


 

2. DESCRIPTION OF PRIZES

 

1 prize of $1,000 to be won in the form of a coupon redeemable at a Beaulieu Canada retailer. The amount of $1,000 is applicable on the Beaulieu Canada Nyluxe PetGuard and Nyluxe PetGuard Tri-Twist carpet styles only. It cannot be applied to transportation, installation, payment of taxes or accessories. 


 

3.    GENERAL CONDITIONS 

 

3.1.    To be declared a winner, the entrant selected in a random draw must correctly answer a mathematical skill-testing question.

3.2.    By entering the Contest you : 

3.2.1. Acknowledge that you have read, accepted and comply with the Contest rules;

3.2.2. Confirm that you meet all Contest eligibility requirements and accept and participate in the prize (if you win);

3.2.3. Subject to correctly answering the mathematical skill-testing question, accept the prize offered by Beaulieu Canada as awarded;

3.2.4. Consent to the use of your name, the name of your city and province of residence, your image, your statements and/or your voice, as well as your participation, without compensation by Beaulieu Canada for promotional and other purposes related to the Contest;

3.2.5. And your heirs, successors and assigns release Beaulieu Canada and any Sponsor/Prize Provider and its/their respective affiliates, subsidiaries, directors, officers, agents, consultants, volunteers and employees (the "Contest Organizers") from any and all liability for any compensatory, direct, indirect, consequential or other damages that may arise from your participation in the Contest, the use of your entry and the awarding, acceptance and use of the prize awarded (if you win). 

 

3.3. The prize must be accepted as awarded and cannot be exchanged, refunded, sold or transferred. No substitutions will be made. Any unused portion of a prize awarded, for any reason, will be forfeited.


 

3.4. Refusal to accept the prize or any portion of the prize releases the Contest Organizers from any obligation to the winner with respect to the prize or the portion of the prize in question.


 

3.5. In the event of a dispute or complaint that an entry is in violation of these Contest rules, entries will be deemed to have been submitted in accordance with these Contest rules by the authorized account holder of the account used to submit the entry in question. You may be required to provide proof (in a form acceptable to Beaulieu Canada) that you are the authorized account holder of the account used to submit the entry in question and, if applicable, that you have all necessary consents, authorizations and/or licenses as required by these rules. If Beaulieu Canada determines, in its sole discretion, that an entry is in violation of these Contest rules, the entry will automatically be disqualified from the Contest.

 

3.6. The decisions of Beaulieu Canada with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, all decisions regarding the eligibility/disqualification of entrants and/or entries.

3.7. Beaulieu Canada reserves the right to amend the Contest rules or to terminate the Contest at any time, without liability of any kind to any entrant. Any changes to the Contest rules will be posted on the Website. Without limiting the foregoing, Beaulieu Canada reserves the right to adjust, without prior notice, the dates and/or deadlines mentioned in these Contest rules, when necessary, as a result of technical or other problems, or in light of any other circumstance which, in the opinion of Beaulieu Canada, in its sole discretion, affects the proper administration of the Contest as provided for in these Contest rules, or for any other reason.

3.8. The Contest Organizers are not responsible for any loss, damage or harm of any kind, including but not limited to: (i) lost, stolen, late, damaged, misdirected, destroyed, illegible or incomplete entries; (ii) loss, theft or loss of integrity of computer or telephone software or data, including invasion of privacy; (iii) fraudulent calls; (iv) the inability of any person to participate in the Contest for any reason, including, but not limited to, incorrect postal or e-mail addresses, computer or telephone failures, or any other problems with computer online systems, servers, access providers, computer equipment or software; lost, late, incomplete, illegible or misdirected entries; bugs, service failures, hardware or software transmission failures or losses, transmission delays or compromise of transmitted data, congestion on the Internet or at any other website, or any combination of the foregoing; (v) damage to any person's computer equipment, including that resulting from the use or downloading of any content related to the Contest; (vi) any delay or inability to act due to any event or circumstance beyond their control, including, but not limited to, strikes, lockouts or other labour disputes at their place of business or the places of business of the organizations or companies whose services are used in connection with the Contest; (vii) loss, breakage or misdirection of prizes during delivery; or (viii) loss, damage, defects or inability to use the prize once awarded to the winner for any reason whatsoever.

3.9. Social Media or other platforms used for this Contest, as well as their parent companies, affiliates, directors, officers, agents, consultants, volunteers and employees are not liable for any damages, compensatory, direct, indirect, consequential or otherwise, that may be caused by or arise in any way from participation in the Contest or the downloading of any information related to the Contest.

3.10. You agree that in your use of social media or other platforms for this Contest, including, but not limited to, in chat areas and registration and in the use of social media accounts, usernames or group names, you will not use any obscene, defamatory or offensive language, that infringes on any third party's trademark or trade name, or that violates any other intellectual property or privacy rights. 

3.11.  If Beaulieu Canada determines that any person is tampering with or misusing any aspect of the Contest, including but not limited to, violating the Contest rules, attempting to enter the Contest more than the maximum number of times permitted or acting in a manner which is disruptive to the normal operation of the Contest, such person will be disqualified. Any person who enters or attempts to enter the Contest using robotic, automatic, macro or programmed methods, or any other similar method, or through third parties, will be disqualified at the sole and absolute discretion of Beaulieu Canada.

3.12. Where the Contest rules permit the use of social media such as Facebook, Twitter or any other social network to participate, entrants are advised that the social media and each of its managers and agents assume no responsibility whatsoever for the conduct of the Contest. However, by participating via social media, all rules governing the use of social media apply.

3.13. Beaulieu Canada reserves the right to cancel or suspend the Contest at its sole discretion for any reason, including, but not limited to, if a virus, bug or other factor beyond its control corrupts the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws. In such a case, Beaulieu Canada reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 

3.14. The personal information requested on the entry form, such as name, age (if applicable) and contact information, is collected, retained and used by Beaulieu Canada and its representatives for the purpose of administering the Contest and for any other purpose to which you have consented upon registration. By providing your personal information, you expressly consent to the Privacy Policy.

3.15. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address at the time of entry will be deemed to be the entrant. The person who is assigned to the email address for the domain associated with the submitted e-mail address is deemed to be the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email account associated with the entry. All entries must be submitted from a valid email account that can be identified by a reverse domain name search. The time and date of submission of a Contest entry, for purposes of determining the validity of such submission, will be determined solely by the Contest server.

3.16. The odds of winning depend on the number of eligible entries received. Beaulieu Canada reserves the right to disqualify any entries that are incomplete, illegible, damaged, irregular, submitted by illicit means, sent by automated or robotic mailing methods that artificially increase the odds of winning or that do not strictly comply with the Contest rules. Beaulieu Canada disclaims all liabilities for any errors or omissions in the printing of materials or advertising related to the Contest. 

3.17. In the event of any discrepancy or inconsistency between these Contest rules and disclosures or other statements contained in any material related to the Contest, including, but not limited to, the Website and/or point of sale, television, print or online advertising, the French version of these Contest rules and/or any instructions or interpretations of these rules provided by any representative of Beaulieu Canada or Beaulieu Canada's terms and conditions of use, the terms and conditions of these Contest rules shall prevail to the fullest extent permitted by law.

 

3.18. The invalidity or unenforceability of any provision of these Contest Rules shall not affect the validity or enforceability of any other provision. If any provision is held to be invalid, unenforceable or illegal, these Contest Rules shall remain in full force and effect and shall be construed in accordance with their terms and conditions as if such provision were not contained herein.

 

3.19. By entering the Contest, entrants agree to abide by these rules and the decisions made by Beaulieu Canada, which are final and binding.

 

3.20. Participation in the Contest, as well as the entrant's agreement to participate and comply with the Contest rules, are governed by the laws of the province of Quebec and the federal laws of Canada applicable therein. By submitting their entry form, entrants agree to submit to the exclusive jurisdiction of the courts of Quebec.
